TERMS AND CONDITIONS
PLEASE READ CAREFULLY. By participating in the U.S. SOCCER INSIDERS PROGRAM, you agree to the following Terms and Conditions:
1. Overview of the U.S. Soccer Insiders Program
1.1. The U.S. Soccer Insiders Program (the “Program”), is a loyalty program sponsored by The United States Soccer Federation Inc. (“U.S. Soccer”) through which you will be offered the opportunity to earn rewards (“Points”) by making qualifying purchases as well as through other non-purchase methods described below, and through other methods that may be added from time to time by U.S. Soccer, in its sole discretion. Participants in the program (“Members”), may access the Program by using the U.S. Soccer mobile application (the “App”).
1.2. By participating in the Program and becoming a Member, you agree that you have read, understand, and agree to be bound by the following terms and by any modifications that U.S. Soccer may make. Furthermore, by becoming a Member, you also agree to be bound by U.S. Soccer’s Terms of Use (the “Terms of Use”) and you acknowledge that you have read and understood U.S. Soccer’s Privacy Policy (the “Privacy Policy”). For the avoidance of doubt, your continued participation in the Program after any changes or modifications have been made to any of the terms herein constitutes your consent and agreement to be bound by such terms.
1.3. The Program has no predetermined termination date and may continue until U.S. Soccer, at its sole discretion, elects to designate a termination date for the Program. In the event that the Program terminates, U.S. Soccer will notify you of the termination date pursuant to section 7.3.
1.4. Members may earn Points by performing any of the activities (“Qualifying Actions”) outlined in the Points chart on the App (“Points Chart”), which is incorporated by reference into these Terms and Conditions.
2. Eligibility
2.1. The Program is open to legal residents of the fifty (50) United States (including the District of Columbia), Canada (excluding the Province of Quebec), and the United Kingdom who are thirteen (13) years of age or older or have reached the age of majority in their jurisdiction of residence at the time of enrollment. Void where prohibited by law.
2.2. If you are between the ages of 13 and 18, you may participate in the Program only with the permission and under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions. U.S. Soccer encourages parents to supervise their children’s digital activities.
3. Enrolling in the Program
3.1. Participants must enroll in the Program to become a Member by downloading the App or visiting ussoccer.com/insiders and supplying the required information to complete a basic account (“Account”). Extended profile information may be required for higher tier accounts, if applicable.
3.2. Limit: one (1) Account per person. The person who is the holder of the Program membership Account associated with the email address used to register for the Program will be deemed the Member for that Account.
3.3. If it is discovered that any Member has attempted to: (i) obtain more than one Account; and/or (ii) use or attempt to use multiple names, identities and/or more than one e-mail address to establish Account(s), then, in the sole and absolute discretion of U.S. Soccer, you may be disqualified from participating in the Program and we may cancel your Account, de-activate or cancel all of the Program Accounts you have established. Further, U.S. Soccer may refuse to allow you to re-register in the Program.
3.4. We may cancel your Account, if, in the sole and absolute discretion of U.S. Soccer, any information you provide to us is not truthful, accurate and complete. Use, or any attempted use, of any automated, macro, script, robotic or other systems(s) or program(s) to register for or otherwise participate in or disrupt this Program is strictly prohibited and is grounds for disqualification.
4. Earning Points
4.1. Subject to Section 5, Members may earn Points or other rewards by performing any Qualifying Actions outlined in the Points Chart. Qualifying Actions may include, without limitation, (i) Member engagements; (ii) upgrade bonuses; (iii) U.S. Soccer store purchases; and (iv) Ticketmaster purchases. Select Qualifying Actions are described below.
4.1.1. Complete your basic profile: Available only to participants creating their first basic profile through the App or ussoccer.com/insiders. This is defined as completing a basic profile through the provision of your (i) name; (ii) last name; (iii) electronic mail address; (iv) birth date; (v) self-generated password; and (vi) address. Member can only earn points for Qualifying Actions after they sign up and while they have an active and valid account.
4.1.2. Extended Profile Completion: To complete an extended profile, the member must, in addition to the information provided to complete a basic profile, provide additional information such as, but not limited to, their (i) gender; (ii) shirt size; and (iii) favorite player.
4.1.3. Vote for player to win player of the match: At various times during the Program, the ability to vote for a player to be named player of the match will be available through the App. Members will be limited to one vote per match.
4.1.4. Match Attendance: For USMNT and USWNT matches, Members who sign into their Account in the App and enable location settings will be identified when they enter the stadium perimeter with their phone once gates open. Members will be given a Cap for each match they attend and earn points for each Cap. Members who are not able to earn Points via the App can alternatively request to earn credit via the Insider Cap Request Form located here: https://fs9.formsite.com/mteeterussoccerorg/insidercaps/index.html
4.1.5. Huddle attendance: Before certain matches, Members may be invited to join a private video chat with a coach, general manager, or other team stakeholder. Members must RSVP for the Huddle with the same email address linked to their Insider account and then also attend the Huddle virtually via the video conferencing solution chosen by U.S. Soccer.
4.1.6. Upgrade bonuses. Three tiers of membership are available to Program Members with higher tiers offering additional benefits. Members who complete a basic profile are automatically enrolled in the standard tier at no cost. A Member who elects to purchase a higher tier will be awarded Points as outlined in the Points Chart.
4.1.7. U.S. Soccer Store purchases: The ability to make purchases from the Official U.S. Soccer Store (“U.S. Soccer Store”) is available to Members through store.ussoccer.com. When a qualifying purchase is deemed final, as determined by U.S. Soccer, Members will be awarded the amount of Points reflected in the Points Chart. LIMIT: Members are limited to earning 10,000 points from purchases per any seven (7) day period. Qualifying purchases are net of taxes, shipping, and any store credits applied to the order. Returned items will result in points being deducted from the Member’s account at the same dollars-to-points rate they were earned. All transactions will be converted into U.S. Dollars for purposes of calculating Points. If Points accrued have already been redeemed, leaving fewer Points in the Member’s Account than the amount to be deducted, U.S. Soccer will debit Points from the Member’s Account to the extent possible and deduct future Points earned by the Member through Qualifying Actions until U.S. Soccer is made whole.
4.1.8. Ticketmaster Purchase: Members have the ability to purchase tickets for many (but not all) USWNT and USMNT matches via Ticketmaster on the App, the Ticketmaster app, or ticketmaster.com. Qualifying purchases do not include Verified Resale Tickets. Points can only be earned for the face value of the ticket (excluding taxes) and on a maximum of 10,000 points from ticket purchases per any seven (7) day period. Members must use their own Ticketmaster account and it must be linked to the same email address used for their Insiders account.
5. Points Restrictions
5.1. U.S. Soccer reserves the right in its sole discretion to add, remove, or change the number of Points awarded for actions as well as the actions that you can perform to earn Points, at any time throughout the Program. U.S. Soccer will update the Points Chart to reflect such changes, consistent with modifications made pursuant to Section 7.1.
5.2. You may not combine or transfer Points with others’ Accounts. You may not transfer, sell, or perform any other action in any manner in violation or attempted subversion of these Terms and Conditions. Any attempt to combine, transfer, or sell Points may result in cancellation of your Account. U.S. Soccer reserves the right to take any other or additional action it deems appropriate in its sole discretion in the event that U.S. Soccer believes (in its sole discretion) that you (or you and others) have violated this provision or any law.
5.3. You are responsible for the payment of all taxes, if any, which may result from the Points received as part of the Program.
5.4. Once you earn Points, the validation of the potential Points earned will be subject to verification. Points will not be awarded until after the verification process is complete. Points are void if: (a) you do not meet the eligibility criteria; (b) you fail to fully and completely satisfy the requirements set forth in Section 4; (c) you attempt to earn Points by automated means, such as, but not limited to, using a script or bot that only simulates the completion of a Qualifying Action; or (d) you have not otherwise earned the Points in accordance with these Terms and Conditions and through legitimate channels. U.S. Soccer reserves the right, in our sole and absolute discretion, to invalidate any Points we deem to have been awarded in error, or as the result of any fraudulent or dishonest activity, or any activity not in keeping with these Terms and Conditions as reasonably interpreted by us in our sole discretion. Any Points that cannot be verified to the satisfaction of U.S. Soccer are subject to disqualification.
5.5. You are responsible for ensuring the accuracy of your Account and are encouraged to check your Account regularly.
5.6. If you believe that Points were not properly accrued to your Account, you must contact customer service by emailing insidersupport@ussoccer.org within 30 days of the day of the purchase date or non-purchase action. Claims not made within 30 days of the Qualifying Action will be deemed waived.
5.7. Individuals or entities buying tickets in bulk quantities for the purpose of resale on the secondary market are not eligible to be Insiders and earn Points. U.S. Soccer reserves the right to disqualify points and deactivate accounts for Members that it deems a broker.
5.8. U.S. Soccer decisions regarding the awarding of Points are final and binding. Earned Points that are subsequently determined to be invalid for any reason are subject to disqualification and will be removed from your Account without notice. U.S. Soccer also reserves the right to cancel Accounts for illegitimate activity.
6. Redeeming Points
6.1. Except as provided herein, a Member may redeem his/her/their accrued Points for any featured item or experience (“Redemption Item”) (i) available to them based on their membership tier, (ii) listed and in stock on the App at the time of redemption, and (iii) specifically designated by U.S. Soccer as eligible for Point redemption. U.S. Soccer reserves the right to change the amount of Points required for Redemption Items at any time in its sole discretion. To select a Redemption Item the Member must have the full amount of Points required for the Redemption Item at the time of redemption; Points may not be combined with cash or other consideration for Redemption Items.
6.2. Any Redemption Item that involves an experience is limited to one person per Redemption Item.
6.3. A Redemption Item entitling a Member to store credit for purchases made on the U.S. Soccer Store (Store Credit) is subject to the following additional terms.
6.3.1. Points may be redeemed for Store Credit in set increments, as specified by U.S. Soccer. Increments may change without notice.
6.3.2. Upon redemption of Points for Store Credit, Member will be sent a confirmation email containing a Store Credit Code. The date of issuance of the Store Credit is the date that the confirmation is sent to the Member’s email address associated with the Member’s Account.
6.3.3. EXPIRATION OF STORE CREDITS: Store Credits are good for one (1) year from the date of issuance.
6.3.4. Store Credits are non-transferable.
6.3.5. SINGLE USE. DO NOT REDEEM MORE STORE CREDIT THAN YOU NEED TO PURCHASE ITEMS WITH STORE CREDITS BECAUSE STORE CREDITS MUST BE USED IN A SINGLE TRANSACTION. STORE CREDIT LEFT OVER WILL NOT BE SAVED OR RETURNED.
6.4. U.S. Soccer, in its sole discretion, may revise, limit, or discontinue the Redemption Items offered through the Program at any time. Redemption Items are always subject to availability. In the event that US soccer is unable to provide a Member with a selected Redemption Item for any reason, U.S. Soccer, in its sole discretion, reserves the right to either (i) return the points to the members account or (ii) provide another Redemption item of equal or comparable value.
6.5. Warranty. U.S. Soccer makes no representation or warranty with respect to Redemption Items obtained through the Program to the extent allowed by applicable laws.
6.6. REDEMPTION ITEM SELECTIONS ARE FINAL. All selections of Redemption Items through the Program are final and Points will be deducted immediately from your Account.
6.7. U.S. Soccer is not responsible for defective, lost or incomplete items, mishaps, injuries or other damages, or Program Members’ dissatisfaction with any Redemption Item redeemed. All physical Redemption Items will be shipped to the billing address associated with the Member’s Account.
6.8. For experiential Redemption Items that take place within the stadium on match day, Members are responsible for their own entry to the match. Match tickets or stadium admission is not included with any Redemption Items. For example, taking part in the flag unfurling during pre-game requires the Member to obtain a ticket for the match.
6.9. No purchase necessary to enter sweepstakes listed as Redemption Items. Sweepstake entries identified as being redeemable via points can also be earned by free alternative method of entry. To enter sweepstakes via alternative method, hand print your name, your email address, phone number, the name of the sweepstakes, and the description of the sweepstakes as it appears in the app and mail it in an envelope with correct postage to: U.S. Soccer, Attn: Insiders Support, 1801 S Prairie Ave, Chicago, IL, 60616. One entry per envelope. All entries become the property of U.S. Soccer. U.S. Soccer is not responsible for illegible, late, lost, or incomplete entries, which will be disqualified.
6.10. Store Credit and certain other types of items (e.g., coupons, third-party gift cards) may have additional terms and restrictions, of which you are responsible for reviewing and understanding.
7. Modifications, Program Termination, and Account Cancellation
7.1. U.S. Soccer reserves the right to modify the Program, including the Points Chart, at its discretion, at any time. U.S. Soccer also reserves the right to modify any of the Terms and Conditions set forth herein at any time, even though these changes may affect your ability to accrue or use your Points. Modifications may include, but are not limited to, the Qualifying Actions, the Point values, the number of Points that may be redeemed through the Program, the nature and value of the Redemption Items, the duration of Points, and any of the options made available to you with respect to your Account. Any modification to the Program or these Terms and Conditions, including the Point Chart which is incorporated by reference, is effective immediately as of the date indicated at the beginning of these Terms and Conditions. Your continued participation in the Program constitutes your acceptance of any changes to these Terms and Conditions. You are responsible for remaining knowledgeable as to these Terms and Conditions. The most current version of these Terms and Conditions supersedes all previous versions.
7.2. U.S. Soccer reserves the right to terminate the Program at any time, for any reason, even though termination may affect your ability to accrue or use your Points. In the event of termination of the Program or closing of an account, you will have at least thirty (30) days from the date Program termination is announced to redeem your Points. Upon Program termination, notwithstanding your ability to redeem Points within the time allowed, the right to use the Program and accrue future points ends immediately.
7.3. U.S. Soccer reserves the right to cancel your Account at its sole discretion, in accordance with these Terms and Conditions.
8. General Terms and Conditions
8.1. Privacy. The Privacy Policy will apply to this Program and to all information that we receive from your registration in the Program. Please read the Privacy Policy available through the App or at ussoccer.com/privacy-policy before registering for the Program. You acknowledge that you have read and understood the Privacy Policy.
8.2. Publicity Release. By participating in the Program, U.S. Soccer, its subsidiaries, affiliates, partners, and licensors (the “Entities”) shall have the right, but not the obligation, to use, display and publish your name, photograph, likeness, voice, biographical information and/or statements (the “Contribution”), throughout the world in perpetuity in any media that now exists or may exist in the future including for advertising and promotional purposes, and you hereby irrevocably grant to the Entities all necessary consents and assign to the Entities all rights in and to the Contribution (including, without limitation, the copyright, all performers' property rights and any rental and lending rights together with all renewals, revivals, reversions and extensions thereof and accrued rights of action) to enable the Entities to make the fullest use of the Contribution worldwide. If U.S. Soccer makes use of any of the foregoing rights, you understand and agree that you will not receive any other consideration, or payment, notification or credit, nor will you have any approval over how the foregoing rights are used.
8.3. U.S. Soccer reserves the right to discontinue your participation privileges if you engage in any fraudulent activity or use the Program in a manner inconsistent with these Terms and Conditions or any federal, municipal, provincial, state or local, laws, statutes, or ordinances. Discontinued participation privileges may result in the loss of all accumulated Points. In addition to discontinuance of participation privileges, U.S. Soccer shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.
8.4. Opting-out of the Program will result in the loss of all accumulated Points. Any Member who opts out, then re-registers for the Program will be treated as a new user to the Program. Accumulated Points and Rewards are not transferrable.
8.5. The Program is provided to individuals only. Corporations, associations, or other groups may not participate in the Program. It is fraudulent for any individual or company, association, or group to direct, encourage, or allow individuals to use a single Account for the purpose of accumulating points for combined use.
8.6. Points do not constitute your property and may be revoked at any time by U.S. Soccer as set forth herein. Points may not be transferred or assigned, and are not transferable upon death, as part of a domestic relations matter or otherwise by operation of law. Points earned in the Program are not valid in, and may not be used in combination with, any other program offered by U.S. Soccer or third parties.
8.7. U.S. Soccer is not responsible for any incorrect or inaccurate information supplied by you while registering for or participating in the Program.
8.8. All questions or disputes regarding eligibility for the Program, earning or redemption of Points, or your compliance with these Terms and Conditions will be resolved by U.S. Soccer in its sole discretion.
9. LIMITATION OF LIABILITY
9.1. The Entities are not responsible for incorrect or inaccurate transcription of information, for problems related to any of the equipment or programming associated with the Program or utilized by you, for any human error, for any interruption, downtime, deletion, omission, defect, or line failure of any telephone network or electronic transmission, for problems relating to computer equipment, software, inability to access the Site, or for any other technical or non-technical error or malfunction. TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE (EXCEPT IN THE UNITED KINGDOM), SHALL THE ENTITIES, AS WELL AS OUR PARENTS, SUBSIDIARIES, AFFILIATES OR SERVICE PROVIDERS, AND EACH OF THEIR AGENCIES, SUPPLIERS AND OTHER COMPANIES INVOLVED IN THE DEVELOPMENT OR EXECUTION OF THE PROGRAM (“RELEASEES”) BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE PROGRAM OR MERCHANDISE OR ITEMS OFFERED THROUGH THE PROGRAM, EVEN IF ANY OR ALL OF THE FOREGOING OR ANY OF THEIR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF THE ENTITIES IMPROPERLY DENY YOU ANY POINTS, LIABILITY WILL BE LIMITED TO THE EQUIVALENT AMOUNT OF POINTS. BY PARTICIPATING IN THE PROGRAM, YOU WAIVE ANY AND ALL RIGHTS TO BRING ANY CLAIM OR ACTION RELATED TO SUCH MATTERS IN ANY FORUM BEYOND ONE (1) YEAR AFTER THE FIRST OCCURRENCE OF THE KIND OF ACT, EVENT, CONDITION OR OMISSION UPON WHICH THE CLAIM OR ACTION IS BASED, UNLESS SUCH WAIVER IS PROHIBITED BY APPLICABLE LAWS. TO THE FULLEST EXTENT ALLOWABLE BY LAW, THE RELEASEES SPECIFICALLY DISCLAIM ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE REDEMPTION ITEMS, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU. You agree to rely solely on the manufacturer's warranties, if any, for any Redemption Items redeemed through this Program.
9.2. As a condition of participating in this Program, if you are in the United States, you agree that (1) any and all disputes, claims, and causes of action arising out of or connected with this Program, or any Redemption Items obtained through the Program, shall be resolved individually, without resort to any form of class action and exclusively by binding arbitration in the state of Illinois under the International Arbitration Rules of the American Arbitration Association; (2) any and all claims, judgments and awards shall be limited to amounts covering direct damages within the limitations of liability described above and out-of-pocket costs incurred, including costs associated with participating in this Program, but in no event attorneys’ fees; and (3) under no circumstances will you be permitted to seek recovery for, and you hereby waives all rights to claim, punitive, incidental and consequential damages and any damages other than direct damages and/or actual out-of-pocket expenses, and waive any and all rights to have damages multiplied or otherwise increased.
9.3. All issues and questions concerning the construction, validity, interpretation and enforceability of the Terms and Conditions, or your or U.S. Soccer’s rights and obligations in connection with the Program, shall be governed by, and construed in accordance with, the laws of the Illinois, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Illinois, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of Illinois.
9.4. These Terms and Conditions constitute the entire agreement between Program participants and U.S. Soccer pertaining to the subject matter hereof and supersedes all prior or other arrangements, understandings, negotiations, and discussions, whether oral or written. No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof (whether or not similar), nor shall waiver constitute a continuing waiver unless otherwise expressly provided.
9.5. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
9.6. Nothing in these Terms and Conditions shall be deemed to exclude or restrict any of your statutory rights as a consumer.
